Ampun Tuanku, sembah patik mengenai TYT Melaka

Ampun Tuanku beribu ampun, sembah patik harap diampun.

Mengadap Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong Tuanku Syed Sirajuddin Syed Putra Jamalullail.

Ampun Tuanku beribu ampun, sembah patik harap diampun. Di kesempatan ini, walaupun sedikit terlewat, patik ingin mengambil kesempatan menyampaikan salam tahniah atas sambutan Ulang Tahun Keputeraan Duli Yang Maha Mulia Tuanku pada tanggal 5 Jun 2004 baru baru ini.

Patik begitu tertarik dengan titah Tuanku yang menyeru supaya usaha pembanterasan rasuah perlu dilakukan dengan telus dan tegas tanpa mengira pangkat dan kedudukan.

Berkebetulan pula, titah Tuanku ini disampaikan tiga hari selepas Tuanku menyampaikan watikah perlantikan Yang Dipertua Negeri Melaka yang keenam (pada 2 Jun 2004) kepada Datuk Seri Utama Tan Sri Khalil Yaakob, dan sehari selepas beliau mengangkat sumpah jawatan tersebut di Dewan Seri Negeri.

Datuk Seri Utama Tan Sri Khalil Yaakob, sebelum dinamakan sebagai calon Yang Dipertua Negeri Melaka, pernah menjawat jawatan Menteri Besar Pahang sehingga tahun 1999, negeri di mana patik bermastautin sekarang.

Selepas tempoh perkhidmatannya (beliau diangkat menjadi menteri persekutuan), Datuk Fauzi Abd Rahman, bekas timbalan menteri, yang juga bekas ahli parlimen Kuantan dan bekas Ahli Dewan Undangan Negeri (DUN) Beserah, telah membuat laporan polis bersabit dengan dakwaan salahguna kuasa Datuk Seri Utama Tan Sri Khalil sewaktu masih bergelar Menteri Besar Pahang, iaitu telah mengagihkan kawasan balak tanpa mengikut kuota yang ditetapkan oleh Dasar Perhutanan Negara.

Mengikut laporan Datuk Fauzi, tindakan ini telah menjejaskan sumber kewangan dan aliran tunai kerajaan Negeri Pahang sekarang kerana kawasan pembalakan yang boleh menjana hasil di sekitar RM300 juta hingga RM900 juta setahun, telah dibuka lebih awal.

Kawasan yang didakwa disalahagih ini mencakup kuota untuk lima tahun iaitu untuk tahun 2000 hingga 2004, yang bernilai secara keseluruhannya di sekitar RM1.5 bilion hingga RM4.5 bilion.

Patik faham, jika dikatakan seseorang tidak boleh dikatakan salah jika belum dibuktikan bersalah, itu amalan dalam sistem perundangan. Tetapi macam mana boleh dibuktikan bersalah jika laporan yang dibuat tidak disiasat.

Sehingga hari ini patik belum mendengar sebarang kenyataan sama ada dari pihak polis atau Badan Pencegah Rasuah (BPR) ataupun Pejabat Peguam Negara, mengenai perkembangan siasatan terhadap laporan ini.

Dua laporan polis susulan juga telah dibuat oleh beberapa orang pacal rakyat, satu laporan di Pahang dan satu laporan lagi di Melaka, memohon supaya laporan Datuk Fauzi itu disiasat segera.

Sepemerhatian patik, amatlah tidak molek untuk Tuanku memperkenankan perlantikan seseorang ke jawatan seperti Yang Dipertua Negeri Melaka itu, apabila latarbelakangnya diragui. Dengan rasa sedih dan berat hati, patik merafakkan sembah rasa tidak bersetujunya patik dengan perlantikan tersebut.

Untuk kemuliaan dan kedaulatan Duli Yang Maha Mulia Tuanku dan seluruh institusi beraja di negara, patik memohon supaya Tuanku menarik balik perkenan dan perlantikan Datuk Seri Utama Tan Sri Khalil Yaakob sebagai Yang DiPertua Negeri Melaka yang keenam.

Kit Siang: Defer Khalils appointment as governor

Opposition Leader Lim Kit Siang said the upcoming appointment of former Information Minister Khalil Yaakob as the Malacca Yang di-Pertua Negri should to be deferred until he is cleared of corruption allegations lodged against him in two police reports.

This, he said, has to be done before be becomes the governor, as the new post entitles him to immunity from prosecution.

"Has he been cleared by the ACA for appointment as the Malacca governor?" Lim asked.

The opposition leader also questioned if the government had planned to suspend the ACA reports and investigations into the allegations that Khalil had flouted logging regulations while he was Pahang menteri besar.

In 2001, Beserah state assembly representative Fauzi Abdul Rahman claimed that the Umno liaison office under Khalil's stewardship had illegally extracted more logs than the quantity stipulated in its permit.

"What will happen to the corruption reports and the Anti-Corruption Agency (ACA) investigations involving Khalil, particularly in connection with his tenure as Pahang Menteri Besar concerning serious allegations of logging malpractices?" Lim posed in a statement.

Lim, who is DAP chairperson and Ipoh Timor MP, also asked the government to publicly reveal whether Khalil is one of the 18 high ranking individuals said to be under ACA probe.

Meanwhile, in an attempt to increase the pressure, Parti Keadilan Rakyat Malacca Youth chief S Jayathas today lodged a police report against Khalil - the third after Fauzis and Keadilan Pahang Youth chief Razal Alias - on the same issue of logging concessions.

Power-sharing compact

Malacca Chief Minister Mohd Ali Rustam announced yesterday that Khalil will be appointed as the sixth Yang di-Pertua Negri of Malacca next Friday.

The veteran politician is also former Barisan Nasional and Umno secretary-general. He retired from active politics following his decision not to contest the recent general election.

Meanwhile, Lim said the people of Malacca have "legitimate grounds" to be disappointed for Khalils appointment because an anak Malacca will not be appointed to the post.

Another reason, the DAP leader said, was the failure to honour the Merdeka compact in 1957 on power-sharing that the posts of Malacca governor and chief minister would be alternated between the Malays and Chinese.

According to Lim, this compact was observed only once when Leong Yew Koh was appointed Malacca Governor immediately when the country achieved independence in 1957, but never honoured after that.
